Upmode (“we,” “our,” or “the Company”) provides a platform that measures and improves how AI systems describe and recommend brands. This Privacy Policy explains what information we collect, how we use and share it, and the choices available to you. It covers our website and the Upmode platform.
Two kinds of information
This policy covers two kinds of information. Information about you, such as your account details, contact information, sign-in records, and how you use our website and platform: Upmode decides how this information is processed, and this policy governs it. Content a client provides to the platform, and the analysis the platform generates from it: Upmode processes this on the client’s behalf under our agreement with that client. If your information appears in content a client provided, the client controls it, and requests about it should go to the client.
Information we collect
Information you provide directly: your name, email address, and login credentials when you create an account; your multi-factor authentication settings; the content you enter or upload in the platform, such as text, files, and website addresses; credentials for any publishing account you choose to connect; and anything you send us when you communicate with us.
Information collected automatically: the platform uses a login session cookie to keep you signed in and records sign-in events for security. This cookie is necessary for the service to function. Our website uses Google Analytics, which sets cookies to help us understand how visitors find and use the site: the pages viewed, how far visitors scroll, clicks on links to other sites, contact form submissions, and clicks on email links. You may opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-On or by adjusting your cookie preferences. We do not use Google's advertising features, we do not use advertising pixels, we do not use retargeting or cross-context behavioral advertising cookies, and we do not sell or share personal information for advertising.
Publishing accounts
If you connect a third-party publishing account, we store the credentials you enter in encrypted form and use them only to publish content you approve to that account. We keep a record of what was published. When you disconnect the account, we delete the credentials.
Connected Google accounts
A client may connect a Google Search Console property and a Google Analytics 4 property to the platform. Once a day, Upmode reads daily totals from each connected property: for Search Console, the number of times the client's site appeared and was clicked in searches that include the client's brand terms; for Google Analytics, the number of sessions and key events. Access is read only. Upmode never writes to a connected property.
We store daily totals only. We do not store individual visitors, individual searches, or any Google user data. Access uses a service account the client authorizes for its property, and the account's key is stored in encrypted form, in the same way as publishing credentials. When the client disconnects a property, we delete the key and every figure read from that property.
How the platform uses AI services
To provide the service, Upmode sends prompts and queries to third-party AI model providers and search data providers (meaning your brand information and content may be transmitted to external APIs) and stores their responses for measurement and reporting. These prompts reference a client’s brand and products, and may include content you enter or upload. We do not use client content to train third-party AI systems. We do not use personal information to train large language models. We may use aggregated, de-identified content to improve Upmode’s own models.
Automated decision-making
Upmode does not use your personal information for automated decision-making that produces legal effects or similarly significant effects concerning you. The platform's AI-generated analytics and reports are informational tools provided to clients and are not used to make decisions about individuals.
How we use information
We use the information we collect to operate, maintain, secure, and improve Upmode; to provide analytics, reporting, and insights; to communicate with you about the service, support, and, where you have not opted out, marketing; and to comply with law.
Legal basis for processing
Where applicable law requires a legal basis for processing personal information, we rely on the following grounds:
Contractual necessity: we process account information and platform usage data as necessary to provide the Upmode service under our agreement with you or your organization.
Legitimate interests: we process information for security monitoring, fraud prevention, product improvement, and analytics, where those interests are not overridden by your data protection rights. Our legitimate interest in each case is the continued secure operation and improvement of the platform.
Consent: where we rely on consent (for example, marketing communications or optional cookies), you may withdraw consent at any time without affecting the lawfulness of processing before withdrawal.
Legal obligation: we process information when necessary to comply with applicable laws, regulations, or legal process.
How we share information
We do not sell your personal information. We share information with service providers that help us operate Upmode: cloud hosting, AI model providers, search data providers, website analytics, and email delivery. Each is bound to use the information only to provide its service to us. If you connect a publishing account, we send the content you approve to that account at your direction. If you connect a Google property, we read from it at your direction and do not send what we read to anyone else. We may disclose information if required by law, to protect Upmode and its users, or as part of a business transaction such as a financing, merger, or acquisition. We may share aggregated or de-identified information that does not identify you.
A current list of our subprocessors and the specific third parties to whom personal data has been disclosed is available on request at privacy@upmode.ai.
Data retention
We keep account information while your account is active and for up to three years afterward to comply with legal obligations, resolve disputes, and enforce our agreements. Client content and generated analysis are kept according to our Data Processing Agreement with the client and deleted as that agreement provides. Figures read from a connected Google property are kept while the connection is active and deleted when the property is disconnected.
Where data is stored, and security
Upmode is hosted on cloud infrastructure in the United States. If you access the service from outside the United States, your information is transferred to and processed in the United States. Where required by applicable data protection law, we rely on recognized transfer mechanisms to protect personal information transferred outside your jurisdiction, including standard contractual clauses approved by the European Commission and, where applicable, the EU-U.S. Data Privacy Framework. You may request a copy of the relevant safeguards by contacting privacy@upmode.ai. We take commercially reasonable technical and organizational measures to protect information, but no system is completely secure. If a security incident affects your personal information, we will notify you and the relevant authorities as required by law.
Your choices and rights
You may update your account information, opt out of marketing emails at any time, and request access to, correction of, deletion of, or a portable copy of your personal information by contacting privacy@upmode.ai. We will respond to requests within 45 days (or as applicable law requires) and may verify your identity before fulfilling a request. You may designate an authorized agent to submit a request on your behalf, subject to verification of the agent’s authority. Some information may be retained as permitted by law.
Depending on where you live, you may have the right to know what categories of personal information we collect, to access and correct it, to delete it, to obtain a portable copy, and to opt out of its sale or sharing. Upmode does not sell personal information (as “sell” is defined under the California Consumer Privacy Act and similar state laws) and does not share it for cross-context behavioral advertising. We will not discriminate against you for exercising these rights. If we decline a request, we will explain our reasons. You may appeal by replying to our decision, and we will respond to your appeal within 60 days. If you are dissatisfied with the outcome of an appeal, you may contact your state attorney general or, for residents of the European Economic Area, lodge a complaint with your local data protection supervisory authority.
Do Not Track and Global Privacy Control
Some browsers transmit Do Not Track (DNT) or Global Privacy Control (GPC) signals. Because Upmode does not sell personal information or share it for cross-context behavioral advertising, these signals do not change the way Upmode handles your information; the protections those signals request are already in place. We recognize and honor GPC signals as required by applicable law.
Children
Upmode is a business service and is not directed to children. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact privacy@upmode.ai and we will delete it.
Changes to this policy
We may update this policy from time to time. We will post the updated version on our website and update the effective date. For material changes, we will give reasonable advance notice by email or in-product notice.
